In a shocking development in the Scott Peterson death penalty case the California Supreme Court put the brakes on what will hopefully be inevitable.
The California Supreme Court has overturned the 2005 death sentence that was to end Scott Peterson’s life… An appropriate, if not too lenient a penalty for his gruesome, heartless killing of his wife who was eight months pregnant with their son that was to be named Connor.
For those who do not remember the case, Scott Peterson’s wife Laci Peterson was eight months pregnant with their son but Scott Peterson found it too difficult to remain loyal during his wife’s pregnancy and had found himself another woman to keep him entertained.
On Christmas Eve 2002 Scott Peterson took his wife fishing in the San Francisco Bay but decided to use her and his unborn baby for chum. Scott Peterson tried to play the bereaved loving husband for a period of time but the authorities soon caught on to his act…
It was not until April 13, 2003, when the body parts of his wife and son began being found… The first discovery was made by a couple walking their dog that uncovered the decomposing body of a late-term male fetus in a marshy area of the San Francisco Bay shore.
The following day along the eastern shore of the San Francisco Bay the Torso of Laci Peterson was found in a rocky area about a mile from where the fetus was found. The torso was missing the internal organs, head, arms, and most of the legs… The bodies were identified by DNA tests.
On April 18, 2003, Scott Peterson was arrested with $15,000 cash, some survival gear and he had dyed his hair.
Scott Peterson argued that his trial was flawed because of the extensive pretrial publicity surrounding the case but the court rejected that premise saying, “We reject Peterson’s claim that he received an unfair trial as to guilt and thus affirm his convictions for murder.”
However, the California Supreme Court Justices did agree that the “trial judge made a series of clear and significant errors In jury selection that, under long-standing United States Supreme Court precedent, undermined Peterson’s right to an impartial jury in the penalty phase.”
The California Supreme Wise One’s believed that potential jurors were improperly dismissed from the jury pool after saying they personally disagreed with the death penalty but would be willing to follow the law and impose it. They wrote in their unanimous decision:
“While a court may dismiss a prospective juror as unqualified to sit on a capital case if the juror’s views on capital punishment would substantially impair his or her ability to follow the law, a juror may not be dismissed merely because he or she has expressed opposition to the death penalty as a general matter.”
The District Attorney has not indicated if they will retry the sentencing in an effort to secure a new death penalty sentence… The liberal loons in California don’t much support putting anyone in jail for anything much less putting them to death but this guy is a real evil dirtbag and if anyone deserves to take a seat in n old school electric chair it would be this guy…
