The January 6 invasion of the Capitol Building certainly is going to keep lawyers busy.
Not only have lawyers been retained, and now released, regarding the impeachment of President Donald Trump over the incident, but now more lawyers are going to be needed as the first civil suit following the acquittal on Saturday of Trump himself has been filed.
A Democrat Representative from Mississippi, Bennie Thompson, filed suit against Trump, his personal lawyer Rudy Giuliani, and groups identified as being politically “right” including the Proud Boys and Oath Keepers for inciting an insurrection using a law put into place following the U.S. Civil War intended to keep the Ku Klux Klan in line.
Thompson points to Trump’s words and tweets in the months leading up to the insurrection to accuse Trump and Giuliani of mobilizing and preparing their supporters for an attack to prevent Congress from certifying the 2020 election results on January 6…
“As part of this unified plan to prevent the counting of Electoral College votes,” the lawsuit states, “Defendants Proud Boys and Oath Keepers, through their leadership, acted in concert to spearhead the assault on the Capitol while the angry mob that Defendants Trump and Giuliani incited descended on the Capitol. The carefully orchestrated series of events that unfolded at the Save America rally and the storming of the Capitol was no accident or coincidence. It was the intended and foreseeable culmination of a carefully coordinated campaign to interfere with the legal process required to confirm the tally of votes cast in the Electoral College.”
This lawsuit, as well as the impeachment effort, does not rely at all on the president’s own words on January 6 which in no way included instructions to storm the capitol building. In fact, later in the afternoon, President Trump took to the airwaves to tell the crowd to disperse peacefully and go home.
What this lawsuit intends to accomplish is a bit of a mystery since the matter has been demonstrated to not have been of Trump’s making. It also leaves out the true initial antagonizers… ANTIFA and BLM.
